The Ministry of Economy, Environment, and Agriculture of Ukraine announces changes in legislation regarding the deferral (reservation) of employees liable for military service during mobilization and wartime.
Legal Basis:
- Law of Ukraine “On Mobilization Preparation and Mobilization” (Article 131);
- Resolution of the Cabinet of Ministers of Ukraine dated January 27, 2023 No. 76 “Certain Issues of Implementing the Provisions of the Law of Ukraine ‘On Mobilization Preparation and Mobilization’ regarding the Deferral of Conscripts during Mobilization and Wartime”;
- Resolution of the Cabinet of Ministers of Ukraine dated August 13, 2025 No. 991 “On Amendments to the Resolution of the Cabinet of Ministers of Ukraine dated January 27, 2023 No. 76.”

Key Changes:
The procedure for deferral has been supplemented with paragraph 8¹, which grants critically important enterprises and institutions operating in areas of potential or active hostilities, or in temporarily occupied territories (according to the List approved by the Order of the Ministry for Communities and Territories Development of Ukraine dated February 28, 2025 No. 376, registered with the Ministry of Justice of Ukraine on March 11, 2025 No. 380/43786), the right to defer 100% of their employees liable for military service.
Procedure for Enterprises:
- The enterprise submits an application to the Regional, Kyiv City, or Sevastopol City State Administration (or to the Military Administration, if established).
- The application must include:
- the decision of the state authority granting the status of “critically important”;
- the enterprise’s location (per Unified State Register code);
- confirmation of actual operations in areas of hostilities;
- the number of employees liable for military service and those already deferred;
- the additional deferral requirement (in %).
- The administration verifies the information and, upon confirmation, submits it to the relevant state authority, which updates the Unified List of Authorities and Enterprises for Deferral via the Diia portal.
Important! If territories are excluded from the List or if an official end date of hostilities is determined, the deferral quota must be adjusted (reduced).
These innovations enable businesses to preserve human resources and maintain operational continuity under the difficult conditions of martial law.
