Strength in Unity: SRS Supports Business Position and Rejects Burdensome Tax Changes

The collaborative efforts of the business community, experts, and professional associations have yielded a significant result. The State Regulatory Service of Ukraine (SRS) has officially declined to approve the draft law aimed at introducing mandatory VAT registration for Individual Entrepreneurs (FOPs) whose income exceeds 1 million UAH.

Context of the Decision

The draft law proposed radical changes to the administration of Value Added Tax (VAT) for single-tax payers. In practice, this would have meant a forced transition for a significant portion of small businesses to a more complex accounting framework—a move that could have proven fatal for many entrepreneurs under current wartime conditions.

Why Did the SRS Side with Entrepreneurs?

According to the official decision, the regulator identified several critical flaws in the draft law that had been previously highlighted by the business community:

  • Excessive Administrative Burden: Implementing VAT administration requires small businesses to incur additional costs for accounting support, specialized software, and significant time resources.
  • Lack of Cost-Benefit Analysis: The developers failed to provide realistic calculations regarding the cost of implementing this norm for both the businesses themselves and state authorities.
  • Economic Risks: There was a genuine threat of businesses moving into the “shadow economy” or small players ceasing operations entirely. This posed a particular risk to the stability of regional fuel and energy markets.

This successful case is another confirmation that the voice of business carries weight only when it speaks in a consolidated manner.

“We understand the importance of budget revenue, but tax policy should be stimulating, not punitive. The SRS’s refusal to approve this project is a victory for common sense and professional argumentation,” the Association noted.
